The US Supreme Court technically upholds a precedent that proximates the US Constitution, at mininum. They get away with a lot here. Congress has to amend the Constitution if that precedent were to ever expand or diminish.

If the US Supreme Court were to consider its caselaw to be the Constitution unto itself, Congress would immediately get to work as a check and balance.
